On June 28, 2023, the United States Bankruptcy Court for the Southern District of New York (the “Bankruptcy Court”) entered the Order Confirming Debtor’s First Amended and Restated Plan of Reorganization Under Subchapter V of Chapter 11 of the Bankruptcy Code [PACER Docket No. 162] (the “Confirmation Order”).
Pursuant to the Confirmation Order, the Bankruptcy Court approved the settlement of the putative class action instituted in the United States District Court for the Southern District of New York, entitled Hoffmann v. Major Model Management, Inc., Civil Action No. 1:20-CV-6941, against the Debtor by Stephanie Hoffmann on the behalf of the Class 2 Creditors, seeking to recover damages as a result of a data breach by the Debtor (the “Data Breach Action”). The terms of that settlement are set forth in the Debtor’s First Amended and Restated Plan of Reorganization under Subchapter V of Chapter 11 of the Bankruptcy Code [PACER Docket No. 162] (the “Amended Plan of Reorganization”).
Section 2.2.A. of the Amended Plan of Reorganization provides that pursuant to the settlement of the Data Breach Action that each Class 2 Creditor shall receive payment in the amount of $201.23 upon (a) execution of a W-9 tax form, (b) execution of a release, and (c) providing Mount Vernon Fire Insurance Company (“Mt. Vernon”), the Debtor’s insurer, with certain Medicare information.
You must complete the following (a) a W-9 tax form, (b) a form of Release, (c) an Affidavit of Medicare Non-Eligibility to be completed by Class 2 Creditors who are not Medicare eligible, and (d) a Medicare query form to be completed by Class 2 Creditors who are Medicare eligible.
The completed and signed W-9 tax form, Release, and applicable Medicare form to be mailed by no later than December 1, 2023, to: Major Model Management Settlement, c/o Atticus Administration, PO BOX 64053, St. Paul, MN 55164 or by submitting via email at MajorModelDataBreach@atticusadmin.com. Upon receipt of the completed and signed W-9 tax form, Release, and applicable Medicare form from a Class 2 Creditor, checks will be issued in the amount of $201.23 to that Class 2 Creditor.
